Terms of Use

Welcome to awake+align (the "App" or "Service"). These Terms of Use ("Terms") are the agreement between you and awake+align for using the Service. By creating an account or continuing to use the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the involvement of a parent or legal guardian.

2. Accounts

You are responsible for activity under your account and for keeping your login credentials secure. If you believe someone else has accessed your account, contact us at support@awakealign.app.

3. Acceptable use

You agree not to:

• Use the Service in violation of any applicable law or regulation.
• Post content that is harassing, hateful, defamatory, sexually explicit, exploitative, or otherwise harmful to others.
• Impersonate others, misrepresent your affiliation, or scrape or harvest data about users without permission.
• Interfere with or compromise the security, stability, or integrity of the Service.
• Reverse-engineer or attempt to extract source code except where the law expressly allows it.

We may remove content and suspend or terminate accounts that break these rules or put the community at risk.

4. Community and your content

Prayer requests, praise reports, comments, journal entries, photos, and anything else you submit ("User Content") stays yours. By posting User Content you give awake+align a worldwide, non-exclusive, royalty-free license to host, display, and share it only as needed to run the Service (for example, showing your post to other members). Do not post anything you do not have the right to share.

5. Spiritual encouragement and health

awake+align offers spiritual encouragement, devotional material, and general movement guidance. It is not medical, mental-health, financial, or legal advice. Consult a qualified professional before starting any exercise program or making decisions based on content in the App, especially if you have a health condition or injury. You accept responsibility for how you choose to move and participate.

6. Subscriptions and purchases

Paid features may be offered through the Apple App Store (and other authorized platforms). Billing, renewal, cancellations, and refunds are governed by the platform where you purchased your subscription. On iOS, you can manage subscriptions in Settings → Apple ID → Subscriptions.

7. Intellectual property

The Service itself—including branding, design, software, and original programming (excluding your User Content)—is owned by awake+align and protected by intellectual property laws. We grant you a personal, non-commercial, revocable license to use the Service as intended.

8. Third-party services

We rely on vendors such as Apple, Supabase, Stripe, and Vercel. Your use of those services may also be subject to their terms. We are not responsible for third-party products or outages outside our control.

9. Termination

You may stop using the Service at any time. We may suspend or end access if these Terms are violated or if we must do so for legal, safety, or operational reasons. Provisions that should survive (including disclaimers, limits on liability, and indemnity where applicable) continue after termination.

10. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, awake+align disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

11. Limitation of liability

To the fullest extent permitted by law, awake+align and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of fifty U.S. dollars (USD $50) or the amount you paid us for the Service in the twelve months before the claim.

12. Indemnification

You agree to defend and hold harmless awake+align from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the United States and the state where awake+align operates, without regard to conflict-of-law rules. You agree that courts in that state have exclusive jurisdiction over disputes, unless applicable law requires otherwise.

14. Changes

We may update these Terms from time to time. We will post the current version on this page and adjust the "Last updated" date. Continued use after changes become effective means you accept the revised Terms.
